These Terms are an agreement between you and AscentApps LLC, an Arizona limited liability company, about your use of Picotazo. By using Picotazo you agree to them. If you do not agree, do not use the app.
Picotazo requires a paid subscription. Subscriptions are purchased through Google Play and are governed by Google Play's terms in addition to these. The price, the billing period, and whether it renews are shown to you in the app before you subscribe.
Your subscription renews automatically for the period you selected until you cancel. You can cancel at any time in your Google Play account settings; cancelling stops the next renewal, and you keep access until the end of the period you have already paid for. Refunds are handled by Google Play under its refund policy.
Your subscription gives you permission to use the app. It is not a purchase of the app or of any content in it.
You must be at least 18 years old to use Picotazo and to purchase a subscription. By using the app you confirm that you meet that requirement. There is no parental-consent path: Picotazo is not available to anyone under 18, with or without a parent's permission.
You may use Picotazo for your own personal, non-commercial use. You may not copy, modify, redistribute, sell or sublicense the app or its content; attempt to bypass the subscription check; or reverse-engineer the app except where the law expressly allows it regardless of this restriction.
We may change, suspend or discontinue Picotazo or any feature. If we discontinue the app entirely, we will stop selling new subscriptions and stop renewing existing ones, so no one is charged for a period after the app is withdrawn. Because Picotazo runs on your device rather than on our servers, the copy you already have will generally keep working for the remainder of any period you have paid for.
Picotazo is provided "as is" and "as available", without warranties of any kind to the fullest extent the law allows.
Boxing training is strenuous physical activity and carries a risk of injury. Picotazo provides general conditioning sessions and camera-based movement estimates. It is not medical advice, not a diagnosis, and not a substitute for a qualified coach or physician. Consult a physician before beginning any exercise programme, particularly if you have a medical condition, an injury, or have not exercised recently. Stop immediately if you feel pain, dizziness, or shortness of breath. You assume the risk of the physical activity you choose to undertake.
Movement estimates are approximations produced by software from a single camera. They can be wrong, and they are not a measurement of your technique, fitness or safety.
To the fullest extent permitted by law, AscentApps LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of Picotazo. Our total liability for any claim will not exceed the amount you paid for Picotazo in the twelve months before the claim.
Some jurisdictions do not allow these limitations, so parts of this section may not apply to you.
Please read this section carefully — it affects your legal rights and how disputes are resolved.
Informal resolution first. Before starting arbitration or filing any claim, you agree to contact us at [email protected] and try to resolve the dispute informally for at least 30 days after providing notice describing the dispute.
Binding arbitration. Except for the exceptions below, any dispute, claim, or controversy arising out of or relating to Picotazo or these Terms will be resolved by binding, individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, and not in court. The arbitration will be conducted in English; the seat is Arizona; and — at your election — the hearing may be held by telephone, by video, or on written submissions only. The arbitrator's award is final and may be entered as a judgment in any court of competent jurisdiction. The arbitrator has exclusive authority to resolve any dispute about the interpretation, applicability, or enforceability of this arbitration agreement.
Exceptions. Either party may (a) bring an individual claim in a small-claims court that has jurisdiction, and (b) seek injunctive or other equitable relief in court to stop actual or threatened infringement or misuse of intellectual property.
Class-action waiver. You and AscentApps LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or otherwise preside over any form of class or representative proceeding.
30-day right to opt out. You may opt out of this arbitration agreement and the class-action waiver within 30 days of first accepting these Terms by emailing [email protected] and stating that you opt out of arbitration. Picotazo has no accounts, so there is no account email to send it from. Send it from any email address you can be reached at, and include enough detail for us to recognise you if a dispute later arises — the date you started using Picotazo, and, if you subscribed, the Google Play order number. We will not refuse an opt-out because we cannot verify who sent it. Opting out will not affect any other part of these Terms, and it will not affect your subscription or your use of the app in any way. If you opt out — or if a dispute is otherwise not subject to arbitration — that dispute will be resolved exclusively in the state or federal courts located in Arizona, and you consent to their jurisdiction and venue.
Severability. If the class-action waiver is found unenforceable as to a particular claim, that claim — and only that claim — will be severed and proceed in the Arizona courts identified above; the remainder of this section stays in effect.
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules, and applicable U.S. federal law.
We may update these Terms. The version number and effective date above will change, and material changes will be shown in the app before they take effect. Continuing to use Picotazo after that means you accept the updated Terms.
